City Attorney John Barisone Refuses to Acknowledge Pat Colby’s Fake Disability

Santa Cruz City Attorney John Barisone ignored John’s repeated demands that he comply with the Americans with Disabilities Act (ADA), probably because she’s not really disabled. She’s a fake.

Pat Colby asked for a “disability accommodation” to sit along Pacific Avenue and not be required to move every 2 hours, like all the other people sitting along Pacific Avenue. What’s her disability again? Is it mental? Because we all know it’s not “physical” and she moves just fine. She can be seen walking up and down Pacific Avenue on any given day, stalking and videotaping members of SCPD trying to do their jobs. As if their jobs weren’t already difficult enough, Pat and her brother John are a constant nuisance to SCPD. And most Wednesday afternoons, she can be found on the corner of Laurel and Center with her motley crew from HUFF protesting the police. She gets around just fine. No power chair needed. No mobility scooter. Not even a cane. She walks just fine. See for yourself.

Dear Mr. Barisone:

Please see the attached flier about your disability based discrimination and my email to you sent on October 27, 2014. You claimed in the December 18th, 2014 Santa Cruz City Council meeting in response to Council member Micah Posner’s querying that the City of Santa Cruz fully complies with the Americans with Disabilities Act (ADA). You stated the City Attorney’s Office has a “process” for responding to ADA disability accommodation requests.

Unfortunately you have refused (on the telephone to me) and still refuse from my email to provide my sister Patricia Colby a written response to her ADA disability accommodation request as I asked for on October 27, 2014.

I am submitting a California Public Records Act (CPRA) request for the documents which lay out your “process” for handling ADA disability accommodation requests. I am willing to pay a fee of up to $10 for this. I ask that if it is electronically available then it be provided to me via email in electronic form, preferably as a PDF.

It’s despicable you refuse to provide me — as per my voicemail for you left last Monday, January 5th, 2015 — a written explanation about what the Santa Cruz Police Department (SCPD) plans to do (or not do) in response to the Internet death threat against me on the Santa Cruz Topix forum by (former) Take Back Santa Cruz member Tom Cunniff of Aptos — who posts anonymously (like a coward) — and the subsequent threatening note left under my front doormat at my secret residence. My location was only given to the FBI.

You and the SCPD were criminally negligent about what happened at the Mission Gardens Apartments which is funded and administered by the City of Santa Cruz. SCPD officers lied to federal agents about the threat Mission Gardens Apartments criminals presented to me. Once again you refuse to address threats against my life from known criminals. The City Council and City staff are complicit in this.

Question:

Will you provide my sister Patricia Colby a written response to her ADA reasonable disability accommodation request — many others need similar ADA disability accommodations. This would set a much needed precedent for the City Attorney’s Office regarding the Downtown ordinances.

To repeat, my sister requests that the so called “Move Along Law” not be enforced against her:

No person shall allow a display device to remain in the same location on the sidewalk for a
period of time exceeding one hour. After one hour the person who placed the display device on the sidewalk shall not place a display device on the sidewalk within one hundred feet of the original display device location. After one hour the person who placed the display device shall not place a display device in the original display device location, or within one hundred feet of the original display device location, for twenty four hours.

This law was selectively enforced against my disabled client Ms. Kate Wenzell by SCPD Community Service Officer Bradly Barnett to retaliate against her for me filing a U.S. Department of Justice (USDOJ) discrimination complaint against the SCPD, then naming Barnett as a respondent. To recap:

In a telephone conversation last summer, as documented by Robert Norse on his radio
show, you refused to provide me — my sister’s acknowledged representative and advocate — a written affirmation consistent with your verbal approval of her reasonable disability accommodation request so that she could show it to SCPD officers to prove you had in fact authorized her to violate the “Move Along Law”. You refused to set written precedent for others seeking similar accommodations on Pacific Avenue in Downtown Santa Cruz, as I informed you several others wanted disability accommodations like my sister had requested.

Repeated request:

Please respond in writing to my sister’s long overdue reasonable disability accommodation request ASAP to provide a precedent against further disability based discrimination and to demonstrate the City’s commitment in complying with the ADA.

For the public good, I will share your written reply with the media, the Santa Cruz County Grand Jury, the USDOJ, Congress, Governor Jerry Brown, the California State Legislature, the ACLU, disability rights advocacy groups and disability rights attorneys.

In case you ignore this request, I will ask President Obama to require the USDOJ to reopen my Title II ADA complaint against you, Caio Arellano, the City Council, City staff and the SCPD, also adding City Clerk Administrator Bren Lehr as a respondent for refusing to accommodate my disabilities for equal access to public records due me under state law.

I ask that you fulfill this request — notarized in writing — by next Friday via certified post, fax and email (with your notarized letter attached as a PDF).

John Cohen Colby Complains to the President and Gets Ignored Again

John Cohen Colby, likely off his meds and hearing the voices inside his head, believes someone he doesn’t know, who doesn’t know him, is making death threats against him.

Wait! Let me find my tin foil hat first.

He falsely believes that this same person he doesn’t know and who doesn’t know him somehow also violated his sister and mother’s medical privacy, that this person’s girlfriend “likely hacked into the California Highway Patrol and Salinas Valley Medical Hospital’s database and stole that information”, and he demanded that SCSO Sheriff Jim Hart and Santa Cruz City Attorney John Barisone immediately arrest him and his girlfriend and remand them to federal law enforcement.

Sheriff Hart and City Attorney Barisone ignored these demands as they likely do with all of John’s email spam. They probably have their spam filters set to automatically send John’s emails to their spam folders.

Consequently, John then emailed President Obama and the U.S. Senate to open up “synchronous executive branch and Congressional investigations”. Like they have nothing better to do.

And again, John sends this to at least 142 people who couldn’t care less.

re: President Obama and Congress must bring full force of federal government down upon domestic terrorists, hate criminals, fraudsters and thieves

Dear President Obama and U.S. Senators:

It is now clearly apparent the City and County of Santa Cruz (except Santa Cruz City Council member Micah Posner) and their respective law enforcement agencies — the Santa Cruz Police Department (SCPD) and the Santa Cruz Sheriff’s Office (SCSO) — are all conspiring to protect themselves from federal prosecution for aiding and abetting hate criminals from the domestic terrorism group Take Back Santa Cruz (TBSC) by either ignoring my security or intently wanting me to be murdered at the hands of racist, anti-homeless and disability bias motivated hate criminals who desire my death, want me silenced and wish me to suffer extreme emotional torment by attacking my emotional disabilities.

Please read the attached email sent to SCSO County Sheriff Jim Hart and Santa Cruz City Attorney John Barisone (who both refused my demand for written assurances they would arrest and remand to federal authorities hate criminals Tom M. Cunniff and his girlfriend Julia Feldman (an SCSO probation officer who somehow accessed confidential information from my mother’s fatal automobile accident in Salinas, California which only the California Highway Patrol (CHP) and Salinas Valley Medical Center had, so they and their fellow TBSC hate criminals could sully my mother’s memory in order to emotionally assault my sister and I and to destroy our reputations in the community to segregate us from community support and drive us out of Santa Cruz altogether like the SCPD has done to disabled homeless people).

I called Santa Cruz Regional 9-1-1 (SCR 911) dispatch for the SCSO and spoke twice to dispatch supervisor Anita —who claimed her ID# is 753 — while standing outside my home in the dark freezing cold because if I called from my bedroom my landlords would immediately evict me, then being made homeless TBSC would surely kill me. Anita wouldn’t have an SCSO officer call me back in a timely manner and refused for them to call my sister — who is also a victim of the same criminals — falsely claiming that my sister is not a victim while I explained to her why she was. Anita — like other SCR 911 personnel — denied us service under color of law. SCR 911 manager Dennis Kidd worked election night at our polling station, has been a member of TBSC affiliated Facebook groups, and might have passed my secret residential address (known only to the FBI) to SCPD and TBSC hate criminals.

Requests:

Open federal investigations by the FBI, the USDOJ, the Department of Homeland Security (DHS), the Department of Transportation Office of Inspector General (DOT OIG), the Department of Health and Human Services Office of Inspector General (DHHS OIG), the Department of Defense Office of Inspector General (DoD OIG) and the National Intelligence Community Office of Inspector General (NIC OIG) into the City/County of Santa Cruz, the SCPD, the SCSO and SCR 911 aiding and abetting domestic terrorism while trying to silence, even kill, citizen journalists — like my sister and I — from exposing it.

Open synchronous Congressional investigations into the same parties as well as The John Stewart Company (JSCO), TerraCorp Financial, HUD, HUD’s Office of Inspector General (HUD’s OIG), the California Housing Finance Agency (CalHFA), USDOJ Fair Housing Investigator Jonathan Teitel, his supervisors, USDOJ Disability Rights Section Director Jay Bentley, retiring U.S. Attorney General Eric Holder, former U.S. Assistant Attorney General Thomas Perez and all the owners of the Mission Gardens Apartments at 90 Grandview Street in Santa Cruz — including Section 8 fraudsters and slumlords Sam Ridino and Jack Baskin — and the Mission Gardens hate criminals who terrorized and endangered us, other residents and the surrounding SAGE SC neighborhood.

Immediately take out with all the necessary force reserved to the state the domestic terrorism group TBSC and all those who collaborated with it in both the government and the military, like Colonel Ed Lesnowicz and his unknown military-intelligence conspirators.

Time is essential. By the time you receive this email I, my sister and others on TBSC’s “hit-list” may be dead.

Please — in case of our premature death — hold all these hate criminals, their supporters and their enablers accountable using all the fury with which the state can punish them. This is an important test of who the federal government serves: those manipulating the public with hate filled agendas or the interests of compassionate citizens trying to make our country a exemplar towards which other nations can aspire. Does the federal government serve those who seek power through hate and cruelty or does it come down on the side of love, tolerance and integrity.
